- ELITE: SIX WEEKS “TRANSFORM” AGREEMENT
1.1 Elite Transform (the “Programme”) is an educative fixed-term programme which could help you achieve your Target Weight.
1.2 Please enter your total desired weight loss: [. ] pounds.
Please note your Target Weight must be at least 20 full pounds less than your Current Weight to qualify.
1.3 If your Target Weight is more than 40lbs we would recommend you do another transform if possible.
1.4 If the answer to any of the elite: Safety questions between 1 and 13 are ‘YES’, you will need to get written consent from a medical professional before starting transform, or any programme.
1.5 The programme will commence on the date specified by your trainer. This is the “Start Date” and these can occasionally be moved due to circumstances that are reasonably out of our control.
- THESE TERMS
2.1 What these terms cover. These are the terms and conditions on which we provide the Programme.
2.2 Why you should read them. Please read these terms carefully before you sign them. These terms tell you who we are, details of the Programme, how you can qualify for the training fees to be refunded and what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.
- YOUR OBLIGATIONS
3.1 Payment. We ask all transform challengers to have all payments paid 3 days before the course starts, if you sign up within this shorter window, we will ask for a full payment then.
3.2 You must weigh in once each week during the Programme, in an elite studio by an elite trainer only. If you have lost no more than 12lbs by the fifth week of the Programme, then you are not entitled to any refund on the course.
3.3 Change your profile photo and cover photo to “I’m taking the elite: Challenge” which will be provided to you by the Start Date. If you do not have a Facebook account, you must create one adding at least 30 friends. Creating a 2nd profile and not utilising your initial one, without written reasoning prior to starting will void your rights of a refund.
3.4 You must check in on Facebook officially and attend all 18 sessions at your elite: Studio. Activity included. Less than 18 check ins will void your refund.
3.5 In order to take a refund / continuation, you must also provide a written review and a 30 second video testimonial.
4.1 If, at the end of the Programme:
- A) You weigh at least 20 pounds less than your starting weight NOT CURRENT WEIGHT; and
- B) You have complied with all of your obligations listed at clause 3; then you may qualify for a FULL refund of your training fees (£228)
4.2 Only if you satisfy all of the requirements of clause 3 (such satisfaction to be approved by your trainer or studio manager no earlier than the final day of the Programme) then you will qualify for a refund. In order to apply for such refund, you must attend a transform refund review meeting as arranged by your trainer, and sign a transform refund form and then return it to your studio within 7 days of a final weigh in. Your final weigh in must be within 45days from the initial weigh-in day/date.
4.3 We want you to keep training with us! We understand that you may have reached your initial goals, but we want you to continue to train and excel even further. Please discuss this with one of our trainers or studio managers for further details, as you may qualify for discounted training on one of our Fusion programmes.
4.4 Should you decide to take a refund at any of our locations, you may still take part in another Transform in the future, but you may never take a 2nd refund under any circumstances.
4.5 When you have seen great results within elite, you may be advised to add to your progress by taking part on our 10 weeks evolve programme. This is a reinvestment of your £228 and will ensure your upwardly mobile progress continues, and that you don’t return to bad habits. Please speak to a trainer for further details on this.
All Refunds take a minimum of 15 Working Days to allow all checks to be completed.
- INFORMATION ABOUT ELITE AND HOW TO CONTACT US
5.1 Who we are: We are Elite Together Training Limited, a company registered in England and Wales trading as “elite”. Our company registration number is 09939411.
5.2 How to contact us or tell us if there is a problem. You can contact us by telephoning our customer service team on 0191 500 8978 or by writing to us at; Unit 5, Mailing Court Hoults Yard, Walker Road, Newcastle, NE6 2HL. Please use these contact details should you have any questions or a complaint.
5.3 How we may contact you. If we have to contact you, we will do so by telephone or by writing to you at the email address, phone number or postal address you provided to us. When we use the words “writing” or “written” in these terms, this includes emails, SMS messaging service or similar. We have many returning clients after completing our transform programme, some above 3 years, so falling in line with GDPR guidelines we will use this as a standard time-frame to hold data.
- OUR CONTRACT WITH YOU
6.1 Securing a transform place. Our acceptance of your place will happen when you have signed this agreement, made a Commitment deposit to us, at which point a contract will come into existence between you and us.
6.2 You may pay a lower “initial deposit“ to secure your place of £60, not the full £228 in one go. You may choose not to pay the full Commitment Payment immediately. You must, however, pay the remaining Commitment Payment before the start date. If this doesn’t happen, we will void your space and offer it to someone else, as it is a course with limited availability, and we don’t want to waste them. Example £60 deposit + remaining balance of £168 would complete payment of £228.
6.3 If we cannot accept your place. If we cannot secure a place for you, you will be informed, and money refunded accordingly. We cannot reasonably plan for how quickly spaces will fill up, and spaces are sold on a first-come-first-served basis. The only way to secure a space is through a deposit payment.
6.4 elite: Terms: Upon sending this agreement out to the participant, we feel it is reasonable to assume you agree to the terms in the document, to allow us to progress your place on our popular programme. We need to keep accurate group members to allow safe population per studio.
- YOUR RIGHTS TO END THE CONTRACT
7.1 Normal consumer rights apply. You may contact us before 14 days prior to the start date, to end the contract for the programme, but you will not be entitled to a refund of the Initial Deposit unless you end the contract for one of the reasons listed at clause 7.2 below.
7.2 What happens if you have good reason for ending the contract. If you are ending the contract for a reason set out at (a) to (d) below the contract will end immediately and we will refund you in full for any services which have not been provided or have not been properly provided. The relevant reasons are:
- A) We have told you about an error in the price or description of the services you have ordered, and you do not wish to proceed.
- B) We move the start date for no good reason (external factors outside of our control will not apply)
- C) We suspend the Programme, or notify you are going to suspend them, in each case for a period of more than 10 days; or
- D) You have a legal right to end the contract because of something we have done wrong.
7.3 What happens if you end the contract without a good reason. If you are not ending the contract for one of the reasons set out in clause 7.2, the contract will end immediately but you will not be entitled to any refund whatsoever.
- OUR RIGHTS TO END THE CONTRACT
We may end the contract if; you commit a material breach of this agreement or break the rules of the elite studio which you attend. Become abusive, offensive or violent in any format, modern social media rules may apply to this.
- HOW WE MAY USE YOUR PERSONAL INFORMATION
9.1 How we will use your personal information. We will use the personal information you provide to us to:
- A) Provide the Programme to your personal needs;
- B) Process your payment for the Programme; and
- C) Subject to your prior agreement, to inform you about similar products that we provide and may be of interest, but you may stop receiving these communications at any time by contacting us in writing to our Head office.
9.2 Throughout the Programme we will regularly take photos and videos during workout sessions which will then be used on our website, social media accounts and other. Elite will always have rights to these images and videos. Publications which are accessible by the general public for promotional purposes. By signing this agreement, you are permitting us to use such images of you in such ways.
9.3 We will only give your personal information to third parties where the law either requires or allows us to do so.
9.4 Nothing in these terms will affect your legal rights.
